1. Acceptance of Terms

By accessing and using the website homesforsalemorris.com (the "Site") and any services provided by Christy Schmaedeke, REALTOR® ("we," "us," "our," or "Company"), including property search services, market reports, home valuations, SMS/text messaging programs, email communications, and real estate brokerage services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Use ("Terms").

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SITE OR SERVICES.

These Terms constitute a legally binding agreement between you and Christy Schmaedeke, REALTOR®, operating as a licensed real estate agent with Keller Williams Infinity - Elevate Real Estate Team.

2. Use of the Site

Permitted Uses

You may use the Site for lawful purposes only, including:

Searching for properties for personal, non-commercial use
Contacting us regarding real estate services
Accessing market reports and property information
Creating an account to save property searches and preferences
Receiving communications you have opted into

Prohibited Uses

You agree not to:

Violate any applicable local, state, national, or international law or regulation
Post or transmit any content that is harmful, threatening, abusive, harassing, or defamatory
Impersonate any person or entity or falsely state your affiliation
Use any automated system to access the Site without our consent
Harvest or collect contact information from the Site
Use MLS/IDX data for any purpose other than identifying properties you may be interested in purchasing
Reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission

3. SMS/Text Messaging Terms of Service

Program Name: Christy Schmaedeke Real Estate Alerts

Program Description

By providing your mobile phone number and opting in to receive SMS/text messages from Christy Schmaedeke, REALTOR®, you agree to receive the following types of messages:

Property Alerts: Notifications about new listings matching your search criteria
Appointment Reminders: Confirmations and reminders for property showings and meetings
Transaction Updates: Time-sensitive information about your real estate transaction
Market Updates: Information about local real estate market conditions
Customer Service: Responses to your inquiries and support messages
Marketing Messages: Promotional messages about our real estate services (requires separate opt-in consent)

Consent is not a condition of purchasing any property or service.

How You Opt In

You opt in to receive SMS messages by submitting a contact or registration form on homesforsalemorris.com and actively checking the SMS consent checkbox. The checkbox is NEVER pre-checked. By checking the box and submitting the form, you provide your express written consent to receive the message types listed above.

Consent Requirements

By opting in to our SMS program, you confirm that:

You are the owner or authorized user of the mobile device and phone number provided
You consent to receive SMS/text messages from Christy Schmaedeke, REALTOR® at the phone number provided
You understand that consent is not a condition of purchasing any property or services
You are at least 18 years of age

Message Frequency

Message frequency varies based on your activity and preferences. You may receive multiple messages per day during active transactions or when new properties match your criteria. Marketing messages are sent periodically, typically no more than 4 messages per month.

HOW TO OPT OUT — Text "STOP" to Cancel

YOU CAN CANCEL THE SMS SERVICE AT ANY TIME. Text "STOP" to any message we send you. We will confirm your unsubscribe status via SMS and immediately cease all SMS communications.

Additional opt-out keywords accepted: STOP, UNSUBSCRIBE, CANCEL, END, or QUIT.

We will process your opt-out request within ten (10) business days.

Rejoining the Program

To rejoin our SMS program after opting out, sign up again through our website, text "START" or "SUBSCRIBE" to our number, or contact us directly.

Message and Data Rates Disclosure

MESSAGE AND DATA RATES MAY APPLY for all messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

Carrier Liability Disclaimer

CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES. Message delivery is subject to effective transmission from your wireless service provider/network operator. T-Mobile, AT&T, Verizon, and other carriers are not responsible for any delays, failures, or content of messages.

Privacy and Information Sharing — No Sharing of SMS Data

NO MOBILE INFORMATION WILL BE SHARED WITH THIRD PARTIES OR AFFILIATES FOR MARKETING OR PROMOTIONAL PURPOSES. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services necessary to deliver your messages.

Supported Carriers

Major carriers supported include: AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and most regional carriers. Carriers are not responsible for message content.

Program Changes

We reserve the right to modify or terminate our text messaging services at any time, for any reason, without notice and without liability to you.

4. Account Registration

To access certain features of the Site, such as saving property searches and receiving personalized alerts, you may need to create an account. When creating an account, you agree to provide accurate information, keep your password secure, and accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, extended inactivity, or fraudulent activity.

5. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs, videos, and software, is the property of Christy Schmaedeke, Keller Williams Infinity, or our content suppliers and is protected by United States and international intellectual property laws.

Property listing data displayed on the Site is provided through IDX from the MLS, for consumers' personal, non-commercial use only. This data is deemed reliable but not guaranteed.

6. Real Estate Services

Agency Disclosure

Christy Schmaedeke is a licensed real estate agent in the State of Illinois, operating under Keller Williams Infinity - Elevate Real Estate Team. The nature of our agency relationship will be disclosed to you as required by Illinois law.

Not Legal, Financial, or Tax Advice

Information provided through our Services is for general informational purposes only and does not constitute legal, financial, tax, or other professional advice.

Fair Housing

We are committed to compliance with all federal, state, and local fair housing laws. We do not discriminate based on race, color, religion, sex, national origin, familial status, disability, or any other protected class.

7. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHRISTY SCHMAEDEKE, KELLER WILLIAMS INFINITY, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESSING THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Telephone Consumer Protection Act (TCPA) Compliance

By providing your telephone number to us, you consent to receive calls and text messages from Christy Schmaedeke, REALTOR® regarding real estate services. Some communications may be sent using automated telephone dialing systems. You may revoke your consent at any time by texting "STOP," calling (815) 693-5757, or emailing [email protected]. We maintain an internal do-not-call list and honor the National Do Not Call Registry.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Illinois. Any dispute shall first be attempted to be resolved through good faith negotiation. If negotiation fails, any controversy shall be resolved by binding arbitration administered by the American Arbitration Association in Grundy County, Illinois. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS ACTION.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a new "Last Updated" date, and sending email or SMS notification where applicable. Your continued use of the Site after modifications indicates your acceptance of the updated Terms.
